Intro

Welcome to Hörby Marknad – Skånes oldest market!

Hörby Marknad is a festival for the people where the streets in central Hörby become a hub of people and visitors. In Hörby, we have arranged a market for over 270 consecutive years and Hörby Marknad is one of the oldest in Sweden. Hörby Marknad is a festival for the people with ancient origins. On the first (Wednesday) and Thursday of July every year, our streets are filled with people shopping, eating, meeting friends and enjoying themselves.

The special thing about Hörby Marknad is that it takes place in the middle of the village. Restaurants and market stalls are set up along all the streets and squares in the center, and the whole of Hörby is transformed into one big market, bubbling with life.

One of Skåne’s oldest markets

Hörby Marknad is one of Skåne’s and perhaps one of Sweden’s oldest markets, dating back to 1748. Central Hörby is filled with up to 100,000 happy visitors and over 400 vendors, a carnival and a small market with people selling smaller animals. You can also try running Marknadsloppet, cheered on by the entire market!

Market selling smaller animals

By tradition we start early Thursday morning with a small market selling smaller animals. Here you can usually find goats, rabbits, chickens and mini pigs. Children love to walk around this market, watching the animals, and a lot of the children from Hörby have chosen their first animal to bring home right here.

Marknadsloppet (A race during the market)

On Wednesday evening, Marknadsloppet is held. This race has been a part of the market days for over 50 years. The exercise race goes through and around the center of Hörby and there are three distances to choose from; 12.6, 6.1 and 3.4 km. For many, Marknadsloppet is a tradition not to be missed. Information

1. Application

Applying for a spot at the market can be done from November the year before the market.

In your application you should clearly state what assortment you sell.

If you have a so-called ambulatory business (that move around your business) and you can’t bring a cash register that meets the demands of the sale, you can instead write a cash invoice to each customer. Ambulatory businesses apply for all businesses where you go to the client/customer to sell goods or services, for example veterinarians and masseurs. 1.a) Late application

When applying late for a spot at the market, namely two weeks before the first day of the market until the last minute, there will be an additional cost per 3-meter spot and a separate additional cost for food trucks.

2. Information about your spot

If you have an approved spot at the market you have to be there at 10 AM on Wednesday, at the latest. From 7 AM you will have access to your spot in order to prepare it.

• If your spot is empty on 10 AM on Wednesday we will resell to someone else. You will not get a refund.
• Let us know the day before at the latest if you can´t make it on time!
• You are not allowed, under no circumstances, to start packing up your goods before 6 PM on Thursday.

If you pack up your goods after the market opens or before it closes you will risk not to get a spot at the market the following year.

• All of the spots are 3 x 3 meters (except for some of the spots for the food trucks)
• There is a limited number of spots where you can have your car in connection to your spot. (you will find which spots this refers to on the map in BokaMarknad when choosing your spot, this is not something you can inform us about later)
• Electricity (230W) is included in the price of every spot
• All outlets for 3-phase electricity must be notified
• Your booth/tent shall not be built closer than 50 cm from the walls of the house behind, behind the booth/tent you should keep a free path.
• Only tents and trailers will be approved, we will not allow sheds and stalls larger than 3 x 3m. Exceptions may be if Hörby municipality place their own stalls for leasing.

All of the spots at the market should have a sign with information about the latest relevant legislations. The sign should be place visibly, this will be checked during the market.

We do not sell any spots for only one day.

2.a) Distribution of spots

Hörby municipality owns the right to the market and with that have the right to move or deny vendors their spot even if they are a so called ”recurring” vendors. To give away, transfer or sell your spot to someone else is not allowed, unless if this is done together with Hörby municipality.

Hörby municipality has the right to ban vendors who borrowed a spot as well as the vendor that booked the spot, if this is done without Hörby municipality knowledge and approval.

Hörby municipality clearly marks the spots in the market area. A standard spot measures 3 meters wide and 3 meters deep. Vendors must place their counters within their allocated space according to the organizer’s marking and instructions. Within the market area there are staff who refer places and help in general.

The corner toward the neighbor must not be obscured, but must be left free from the counter’s umbrella pole. When sales take place from a cart with doors that open towards the front edge, the doors may under no circumstances extend from the front edge of the spot. The entire equipment, including tow bar, must be accommodated within the marked spot.

2.b) Reimbursement of the rent of a spot at the market

If the vendor is not at their spot by 10 AM on the first market day at the latest, and has not given notice of a later arrival, Hörby municipality has the right to sell the spot to another vendor. Reimbursement of the spot does not take place in such case, unless a valid reason is given, such as illness or engine breakdown.

Valid absence such as illness is proven with a medical certificate. Engine breakdown or similar can be proven, for example, with a receipt from the workshop that carried out the repair work.

If the vendor cancels their spot at least 30 days before the first market day, the entire rent for the spot will be refunded. If the vendor cancels their spot between 29 and 14 days before the first day of the market 50% of the rent will be refunded. If the vendor has not paid the rent yet, they will pay 50% of the rent. Cancelations made within 13 days or closer to the first day of the market are not refunded.

3. Assortment

When filling out the application, the vendor must state which assortment they intend to sell, as well as to which category the assortment belongs to. The spot you get is only valid for the assortment specified in the application. Sales of goods other than those specified in the application give Hörby municipality the right to evict the vendor, sellers who are evicted do not have the right to get rent back.

Vendors who change assortment must consult with the person in charge of vendors from Hörby municipality. If the assortment change is approved, Hörby municipality has the right to change the position of the seller in order to make sure the assortment does not collide with other vendors of the same assortment. There are goods which according to Swedish law are prohibited toys, these may not be sold at Hörby Marknad.

3.a) Subscriptions

Vendors are not allowed to sell subscriptions of any kind.

4. Food sales

Businesses that sell, serve, distribute or otherwise handle food must have the necessary permits that the business requires. When selling food, the provisions of the Food Act livsmedelslagen (2006:804) and the Food Ordinance livsmedelsförordningen (2006:813) as well as regulations issued in support of these apply in applicable parts. If you have a registration for an existing business, for example a restaurant, cafe or shop, then that registration only applies to that business.

Permits at markets, festivals or fairs are only approved if this is explicitly stated in the registration. If there is no permit and your business need to apply for or supplement the notification, this must be submitted to the Environmental Board Bygg- och miljönämnden) no later than two weeks before the current sale.

Decisions on registration must be able to be shown to the staff of the Living Environment – Building & Environment department sektor Livsmiljö bygg och Miljö during the market. It is therefore very important that you bring the decision with you. If the activity starts without the requested documents having been received by the environmental committee, it may lead to sanctions being taken.

Each business must have the following in place

• Decision on registration.
• Self-monitoring program and a person responsible for the operation.

Separate toilets for those of you who handle food are marked next to the market office in Ernst Ahlgrensparken, Bollhusgatan and on Nya Torg. At Hörby IP there is also a separate shower with toilet for those of you who handle food. You can get a tag for Hörby IP at the market office during opening hours. You will also find running water around the market office, Nya Torg and Bollhusgatan.

5. Billing

When Hörby municipality approves your application for a spot the vendor will get an invoice for a registration fee which is the same amount as 20% of the rent for the spot, this is to avoid that spots are booked and then not used. The registration fee is to be at hand of Hörby municipality 10 days after your application approved.

Thereafter the vendor will receive the invoice for the remaining amount, last payment for this invoice is always 31 May.

The invoice can be payed earlier and to the invoice you will receive the rules and guidelines regarding the market. When you as a vendor has received an invoice, you have ten days to dispute the invoice, from the date the invoice is made.

If you do not dispute the invoice you are obligated to pay.

When you pay the invoice you, as a vendor, accept the rules and agreement from Hörby municipality and legally binding contract is established and can’t be terminated unless both parties agree to.

If you apply for a spot later than 30 days before the first day of the market you will have to contact Hörby municipality about what applies regarding payment, spot to rent and others that is needed for you to know.

6. Electricity, LGP, water and sanitary service

6.a) Electricity

Hörby municipality provides electricity within the market area. The provision meets the requirements of the Swedish Electrical Safety Authority for construction of a temporary nature. The vendor who does not order 3-phase electricity ahead of time may be without electricity if it is not available. 230V/300W electricity is included per every 3-meter rental spot. If you have a need for more electricity this must be applied for and paid for.

In all situations, the vendor must have his/her electrical material, devices, etc., approved for outdoor use by the electrical safety agency, if this is not the case, Hörby municipality has the right to cut off the electricity supply for the vendor without compensation. Vendors must have at least 50 meters of their own approved cable for connection in the organizer’s electrical cabinets/sub-centrals. Hörby municipality will connect the power no later than 6 PM the evening before the first day of the market and at least 2 hours after the end of the market on the last day. Electric cables must not cross streets, information about the specified electrical cabinet is provided through email before Hörby Marknad. You can also get this information at the office at Hörby Marknad. LED lights must be used, note that halogen lights are not allowed.

• Forwarding from a neighbor’s power outlet is prohibited
• Heating fans are prohibited

6.b) LGP

When using LPG at Hörby Marknad, you as a vendor must tick the box for LPG in the application. We will submit a map/list to the authority for their control.

ATTENTION! You must report LPG to the Räddningstjänsten Skånemitt Rescue Service Skånemitt yourself.

6.c) Water

The vendors will have the possibility to fill water bottles during the entire market.

You will have access to running water by the office at the market Ernst Ahlgrensparken, Bollhusgatan and Nya Torg. It is important not to take water from other drafts, Hörby municipality only takes samples from the drafts specified above.

6.d) Toilets

Hörby municipality provides toilets for vendors from the evening before the first market day until the market closes. Restrooms are available 24/7 during this period in the market area.

At Nya Torg, Ernst Ahlgrensparken (by the market office), Hörby IP and Bollhusgatan there are several toilets throughout the market, of which at least one in each area is intended for food vendors only. These are the only toilets allowed to be used by food handlers. Codes for the toilets are available upon request. In each area there is also a toilet intended for vendors who do not handle food.

Public toilets are in the park by the market office, Gamla torg, Bollhusgatan, Söderängen and Nya Torg. Vendors may under no circumstance fulfill their needs in any other place than designated toilets.

6.e) Showers

All vendors will have access to showers (and toilets) at Hörby IP (Parkgatan 22, 242 35 Hörby) from Tuesday 4 PM. The vendors will then have access to the showers from 6 AM-10.30 PM until Thursday. Here you will also find separate showers and toilets specifically for food vendors.

Please keep in mind that there are alarms at all other times.

6.f) Cleaning

Hörby municipality ensures that the market area is kept clean and tidy during the execution of the market. At the market office, there are garbage bags at your disposal, of which one per vendor and day is distributed upon request.

Vendors must keep their spot clean during the market days and all junk must be transported to specially designated places. Containers for this are available at Nya torg, Bollhusgatan and Söderängen. Everyone must clean their sales area after the market closes on Thursday. Hörby municipality will charge a fee to vendors who leave their area in disorder.

For visitors, Hörby municipality places garbage cans and PantaMera vessels around the market area.

6.g) Waste

Hörby municipality provides spots for the collection of waste water, deposits, combustibles and corrugated cardboard for the vendors. The vendor is responsible for sorting all other waste.

Hörby municipality provides collection of waste water near the office in Ernst Ahlgrensparken.

Garbage container

Containers on Nya torg and Bollhusgatan provide sorting according to: Corrugated cardboard and Combustible, and on Söderängen there is a container for combustible waste. All the containers is in spot from Tuesday until Friday morning.

Latrine

Hörby municipality is only responsible for emptying public toilets that are for vendors, the public and food vendors. Hörby municipality is also responsible for cleaning the porta potties during the market days. Hörby municipality is not responsible for the latrine from the vendor’s own caravan/mobile home. Hörby municipality does not provide latrine emptying for private use during the market.

Frying fat

When it comes to frying fat, every vendor is obliged to take this home with him/her to hand in for fat recycling at the recycling center. If Hörby Municipality discovers that vendors are flushing out waste from frying fat or other waste that is harmful to the environment, the vendor will be fined.

Regulations on disposable products Förordning om engångsprodukter (SFS 2021:996)

The vendors who handle food must comply with the laws and regulations that have been developed for this type of business. ”Restaurants can offer fast food and drinks in reusable cups and lunch boxes and inform their customers about the negative impact of plastic on the environment according to förordningen om engångsprodukter (SFS 2021:996)”.

The vendors responsibility

The vendors are responsible for all handling connected to his/her own waste, should the waste cause permanent damage/marks on properties or other places, the vendor is responsible for all costs for washing/preparation.

7. Parking

Hörby Marknad offers parking for the vendors, who has not applied for a spot with a car behind, at Söderängen. The vendor cannot demand more length for his vehicle than the length of the rental spot.

Please note that if you have not booked a place with a car behind your spot, you do not have the right to park your car inside the market area. Cars for vendors that have not booked a place with a car behind are referred to Hörby IP (Parkgatan 22, 242 35 Hörby) and Söderängen (with entrance from Strömgatan).

Söderängen

Important information for those who choose to spend the night at Söderängen in Hörby. The distances between the caravans must be at least four meters. A toilet is provided next to the area at Söderängen for everyone who uses the campsite. Electricity is available at all locations. Keep in mind that a spot for the campsite must be notified as an addition to the application for space at Hörby Marknad. Access to Söderängen takes place via Strömgatan.

8. Safety and security

Hörby municipality works actively with safety and security before, during and after Hörby Marknad.

The market streets have a width in the middle of the street so that emergency vehicles can get through. Before the market opens, emergency vehicles will drive in the middle of the street to see that the right width is maintained in case of an emergency call is required during the market’s execution. Sales may only take place within the allocated space, aisles may not be cluttered with goods. It is both about safety and out of consideration for the visitors and colleagues. Vendors who do not comply with this and who do not correct themselves after being admonished, risk being rejected and without the right to a refund of the space rent.

No cars are to be parked on the market streets during the night, in case of an emergency the emergency vehicles will not be able to drive past the parked cars.

8.a) Supervision

Vendors are responsible for their possessions in the market area.

During Wednesday evening and night there is a security guard at Nya torg and Bollhusgatan.

9. Regulations

Vendors who violate these regulations and rules immediately lose the right to their spot and must, at the request of the organizer or their representative, immediately close their business, pack up their goods and leave the market area without any form of compensation. This seller will not be offered a spot at future markets.

9.a) Prohibited goods

Prohibition of selling products that incite people, for example with a racist message, products that are drug-related or products that have pornographic content.

The ban also applies to brass knuckles, throwing stars or other objects particularly suitable to use as weapons in crimes against life or health, as well as spring knives and similar objects. Firecrackers, firework pieces, stink bombs and similar objects, including TRICKY firecrackers, catapults and other projectiles, explosive powder guns etc. with high sound volume as well as all kinds of arena trumpets, sprays of all kinds, also applies to scented sprays.

Knives, other stabbing and cutting weapons and other objects intended to be used as weapons in crimes against life and health. This prohibition does not apply if, according to special regulations, the object is part of equipment for a certain service or task or if the possession is otherwise considered justified, considering the nature of the object, the owner’s needs and other circumstances, and the object is well packaged.

Sales of e-cigarettes may not take place during the market.

9.b) Obligation to follow the organizer’s request

Hörby municipality has the ultimate responsibility for order and safety in the market area. In accordance with this, it is the vendors responsibility to comply with Hörby municipality’s instructions in matters related to the order and safety. Repeated disobedience shall result in rejection from the market without the right to a refund of the rent.

Hörby municipality has the right to close the market for safety reasons if the circumstances are such that Hörby municipality assess that there is a danger to the safety of life, health or property of the vendors or the public. Similarly, if the authority requires the closing of the market. In these cases, force majeure prevails and vendors therefore don’t have right to a refund of rent and fees.

It is the responsibility of the market vendor to follow regulations, obey the organizer, guards and other market staff. Any complaints are reported to the market office.

9.c) Food vendors

Only food vendors with permits are allowed at Hörby Marknad. Permits are to be presenter upon request.

9.d) Sales sign at the rental spot

Market vendors must have a clearly visible sign with the company name, address and telephone number in their place of sale.

9.e) Liability insurance

Must be held by all market vendors/exhibitors.

9.f) Ambulatory sale

Sales may only take place within rented allocated spot. Ambulatory sales are not permitted.

9.g) Market stalls or stands in footpaths

The spray-painted lines on the ground show where the front edge of the stand should be.

It is forbidden to place goods on racks or roof structures in front of these lines. This is not rented sales space and intrudes on passage and safety as well as obscures the opportunity for colleagues to display goods.

9.h) To start packing in advance and early departure

To start packing in advance and early departure is forbidden! This will scare away the visitors/customers and will negatively impact your colleagues’ sales. Specified opening hours of the market must be respected as these have been announced in all communication and marketing around the event.

9.i) Subcontracting of rental spots at the market is not permitted

9.j) Protected area water source

Show environmental consideration so that there is no spillage of chemical products, etc., which can contaminate groundwater sources. Environmental accidents must be reported immediately to the market office for rapid clean-up measures.

9.k) Reservation of rental spot at the market

When you, as a vendor, have paid the registration fee, you have automatically approved all the rules connected to Hörby Marknad and a legal cooperation agreement has been drawn up and cannot be broken without both parties agreeing to this.
